Breath Testing

Law enforcement officers use three different types of methods to determine whether a driver had too much to drink, or is too intoxicated to be driving. One of the methods used is Breath Testing. If a driver is suspected of DUI or DWI, a police officer has the option of asking the driver to submit to a chemical test of the breath. However, various states handle the situation differently. For example, in some states, a police officer can request all three tests including breath, blood, or urine tests, but in most states, a person can refuse to submit to testing. In other states, the officer who suspects that alcohol is involved in an accident, may only ask for a breath test, except if there is a vehicular homicide.

Portable Breathalyzers

A blood alcohol test generally requires the use of a portable Breathalyzer unit, which calculates the amount of alcohol in an individual’s blood. The breath test measures the percentage of alcohol in the driver’s breath, blood, or urine. In some states a person can decide only on taking a blood test. In other states and instances, a person may be offered the chance to be tested by blowing into a breath machine, but if the person resists and refuses to take the test, the chances are good that they can be forced to take a blood or urine test. Unfortunately, even a misdemeanor DUI or DWI case in the US allows a police officer to enforce the tests.
