While it’s true that the perception of DUI lawyers is not always the best, the reality is that there are reputable DWI lawyers who are concerned, sympathetic and caring towards their DUI clients. In fact, the true mission of a DUI attorney is to protect the fundamental rights of the people they represent. To reach their goals, a DWI lawyer is responsible for being aware of the ethics suitable for each case he or she endeavors to win.
What Actions Does a DUI Attorney Take?
When a DUI lawyer takes on a case, one of the first things he or she will do is look for whether the person they are representing was deprived of their constitutional rights. The attorney does that by reviewing each and every detail of the situation from the moment a person is stopped for a DUI, to determining whether a person’s Miranda Rights were read. They will also apply an in-depth search into finding out if any known discrepancies occurred when giving the Breathalyzer or when testing of the blood to determine blood alcohol count. By way of example, if a Breathalyzer was defective, it will give a reading much higher than the reading was in actuality. A DUI attorney who practices ethically will look for anything out of alignment with procedures that could stand in the way of the case. In brief, to a lawyer, if any protocol was compromised, or anything leading to the arrest might infringe on a person’s rights, it is totally unacceptable.
Drunk Driving is a Severe Problem
It is true that drunk driving is a severe problem and there are severe consequences to a person who is guilty of a DUI, but to a lawyer with ethics, it is important to protect someone who is innocent. Therefore the most important thing for a person facing a DUI is to have a DWI lawyer that knows exactly what he or she is doing and how it must be done. To those who think poorly of lawyers, it may appear that a DWI attorney is just trying to win a case by freeing someone who is guilty; however, that isn’t the case. An attorney must do what he or she can to assure that everyone involved in the DUI case has done their jobs correctly. Yes, it’s true that a great many drunk drivers are guilty as charged, but there are a number of cases when an innocent person is charged wrongfully. An ethical attorney wants to be sure that doesn’t happen.
The Job of the DUI Attorney
Whether a DUI lawyer's client is guilty of a DUI or they have been wrongly accused, the DUI attorney's job is to make sure the prosecution proves its case by providing sound arguments and genuine evidence. It is basically the job of a DWI attorney to uphold the constitution by making sure his or her client gets a fair trial. Some may see attorneys as unethical, but in truth, a DUI lawyer will do everything to make sure that his or her client only loses a DUI case if or when the evidence presented is strongly against the person.
